After licence cancellation, DTCP sets takeover, asset-freeze drill for Sector 70 project in Gurgaon

Gurgaon: Weeks after moving to take possession of a 5.1-acre land in Sector 70, the town and country planning department (DTCP) has issued an 11-point directive pertaining to an affordable housing project. The licence — granted on Sept 5, 2019 — to landowners, in collaboration with Ocean Seven Buildtech, was cancelled by the DTCP director on Aug 7. Prolonged construction delays and regulatory violations had been cited as the reasons for cancellation of the project. The directive seeks an evaluation of completed and pending development works, an audited statement of project accounts with details of receipts and expenditure and a compilation of allottees and the amounts collected from them. Third-party rights, collaborators’ and landowners’ claims, loans, mortgages and share pledges are to be assessed, with information sought from revenue and registration authorities, banks and financial institutions. With the police and district administration, officials will now inspect the site and ensure no machinery, plant, material or fixtures are removed or sold. Allegations that assets have already been taken away are to be verified and an inventory prepared. Claimants will have to submit particulars and supporting documents to the office for further proceedings under Rule 19(3). Allottees are to be told not to make any further payment to the coloniser, in line with Rule 19(2)(d).A directorate memo of Sept 2 designated the senior town planner (STP) the nodal officer for the proceedings under Rule 19 of the Haryana Development and Regulation of Urban Areas Rules, 1976. The STP has directed the town planner to carry out the exercise. The officer must coordinate with the district magistrate and revenue authorities to demarcate and take over the entire licensed land and buildings, publish a public notice in newspapers inviting claims from allottees, landowners, collaborators and other stakeholders and install a site board stating that the licence stands cancelled, the land vests with govt and further alienation is barred. In an earlier letter dated Aug 27, the STP had asked the deputy commissioner to direct the Badshapur sub-registrar not to register any sale or lease deed for the land without DTCP’s permission and to make red entries in revenue records against the relevant khasra numbers. The city town planner has been asked to comply in letter and spirit and file a compliance report at the earliest. Copies were sent to the DTCP for information and to the deputy commissioner, who has been requested to take over the licensed land and buildings and hand possession to the STP as nodal officer on behalf of the DTCP, under Rule 19(1). The endorsement to the deputy commissioner is dated Sept 16.
