Prayagraj: The Allahabad high court has ruled that private CCTV cameras cannot be installed or positioned in a manner that interferes with a neighbour’s privacy. The observation came from a division bench of Justice Ajit Kumar and Justice Garima Prashad while disposing of a writ petition that challenged the placement of a CCTV camera by a neighbour. The petitioner, Yogendra Maurya, told the court that his neighbour had installed a camera oriented toward the entry and exit points of his residence. He argued that the camera’s positioning enabled recording of the movements of people entering and leaving his premises, amounting to an intrusion into his private life and a violation of his right to privacy.Recording its view, the court said, “In our considered view, no private CCTV camera can be installed and positioned in such a manner as to interfere with the privacy of a neighbour.” However, the bench did not pass a direct order for removal or repositioning of the camera.Instead, the court directed Maurya to approach the district magistrate (DM) by filing an appropriate application. In an order dated Oct 26, the bench instructed that if such an application is submitted, the DM concerned must consider and decide it within one month of receiving it.
